Every employer will need an Employment Contract that will protect him and company, while ensuring a work friendly environment and job security for the employees. The contract will serve the interests of both the employer and the employee rightfully, so that both will benefit equally from the agreement. Signing an Employment Contract basically will replace the standard employment understanding between the employer and the employee. With this contract, the employer-employee relationship becomes more detailed and each party understands their part perfectly.

Define the Position:

Any Employment Contract should provide a potential employee with a clear understanding of their job requirements, including the name of their work position and the fundamental duties it holds. The Employment Contract should also include the mode of employment and the working hours. When drafting this type of contract you should use clear and brief language that will be easy for the employees to understand.

Term of Agreement:

When preparing an Employment Contract, it should contain elements that are beneficial to both parties. An Employment Contract should indicate the terms and conditions of employment that are applicable to both the employee and the employer to increase, reduce or cancel the contract terms.

Performance:

When the both parties will be reviewing performance requirements for introduction in the Employment Contract, the employer should consider indicating any skills they would like the employee to upgrade during the term of the contract. This includes the production goals and revenue improvement. If the employee will be working in sales position, then Employment Contract should indicate the employer’s expectations on the amount of sales the employee should make per month.

Compensation:

Any potential employee would expect an Employment Contract that will define their compensation terms clearly. The employer should include their overtime approval policy to the contract. If the work position involves commission payment, then the contract should indicate the percentage and how draws against commissions will be handled.

Benefits:

The Employment Contract will show the employee’s benefit package. This will include medical cover, dental health, eye treatment, pension or other insurances offered by the company. The contract should also include other benefits such as paid sick leaves, off days, holidays and vacations that the employee is entitled to.

Other Elements:

This section of the Employment Contract will include other agreements such as non-solicitation periods, non-disclosure language, a non-recruit agreement and a non-compete clause if they are applicable in the company. The contracts can also include the property ownership rights clause that will cover the employer’s ownership of the existing clients and equipment, as well as any licenses or copyrights held by the company.

Termination:

This is the last section of the Employment Contract which will show the termination terms. The employer should clearly indicate the terms and conditions that can lead to the termination of the contract before the end of its term. This section should also indicate under what conditions the employee can decide to cancel their contract and the steps that should be followed to terminate the contract as well as the consequences to follow if either of the parties involved violates the Employment Contract.
